Cotto — Terms of Service

These Terms of Service ("Terms") govern your use of Cotto, a mobile application operated by Point Six Labs ("we", "us"). By downloading, installing, or using Cotto, you agree to these Terms. If you do not agree, do not use the app.

1. The service

Cotto is a nutrition-tracking app that uses AI (Google Gemini) to estimate calories and macronutrients from photos, text descriptions, or barcode scans you provide, and lets you track and review that information over time. Some features require a paid subscription (Section 5).

2. Estimates are not medical advice

Cotto's calorie and macronutrient figures are AI-generated estimates. They may be inaccurate, incomplete, or wrong — especially for home-cooked or unusual dishes. Cotto does not provide medical advice, diagnosis, or treatment, and is not a substitute for professional medical or dietary guidance. You are solely responsible for any decisions you make based on information in the app, including decisions about diet, weight, or health. If you have a medical condition or dietary restriction, consult a qualified professional before relying on Cotto's estimates.

3. Eligibility

You must be at least 16 years old to use Cotto. By using the app, you confirm you meet this requirement. You are responsible for the accuracy of any information you enter.

4. Your account and content

You are responsible for keeping your account credentials secure and for all activity under your account.
You retain ownership of the food logs, photos, and other content you create in the app. By using Cotto's AI features, you allow us to send that content (a meal photo or description) to our AI processing subprocessor (Google Gemini) solely to generate an estimate for you, as described in our Privacy Policy.
You agree not to use Cotto to submit unlawful, abusive, or harmful content, or to attempt to disrupt, reverse-engineer, or abuse the service (including the AI or barcode-lookup systems) beyond normal use.

5. Subscriptions, trials, and billing

Cotto offers free trials followed by paid subscriptions (monthly or annual), billed and processed through Google Play Billing. We never see or store your payment card details.
Trials convert automatically into a paid subscription at the end of the trial period unless you cancel first. The exact trial length and price are shown before you start a trial.
Subscriptions renew automatically until cancelled. You can cancel anytime through Google Play; cancelling stops future renewals but does not refund the current billing period unless required by applicable law or Google Play's policies.
Refunds are handled by Google Play under its own policies, not directly by us.

6. Account deletion and termination

You may delete your account at any time in-app (Settings → Delete Account) or by contacting us — see our Account Deletion page for details. We may suspend or terminate your access if you violate these Terms, misuse the service, or engage in abusive behavior toward our systems (including automated abuse of the AI or barcode-lookup features).

7. Intellectual property

Cotto's app, design, branding, and underlying code are owned by Point Six Labs and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or source code beyond what's needed to use the app as intended.

8. Third-party services

Cotto relies on third-party services (Google Gemini, Supabase, Open Food Facts, RevenueCat, Google Play Billing, PostHog) to function, as described in our Privacy Policy. We are not responsible for outages, errors, or changes in those third-party services that affect Cotto's availability or accuracy.

9. Disclaimer of warranties

Cotto is provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, reliability, or fitness for a particular purpose. We do not guarantee the app will be uninterrupted, error-free, or that AI estimates will be accurate.

10. Limitation of liability

To the maximum extent permitted by law, Point Six Labs is not liable for any indirect, incidental, or consequential damages arising from your use of Cotto, including health, dietary, or financial decisions made based on information in the app. Nothing in these Terms limits liability that cannot be excluded under applicable law (including, where applicable, EU consumer protection law).

11. Changes to these Terms

We may update these Terms as the app changes. Material changes will be reflected by an updated "Last updated" date and, where appropriate, an in-app notice. Continued use of Cotto after a change means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of Romania and applicable European Union law, without regard to conflict-of-law principles, without prejudice to any mandatory consumer-protection rights you have under the law of your country of residence.
